Whitten Chair of Law and Government<\/strong>.<\/p>\n\n\n\n<p>&#8220;There are a bunch of fascinating issues about the boundary of the state,&#8221; Green said. &#8220;Where does the government official end and people&#8217;s private lives begin?&#8221;&nbsp;<\/p>\n\n\n\n<p>In Lindke v. The <strong>6th Circuit Court of Appeals<\/strong> ruled that did not violate the resident&#8217;s First Amendment rights.<\/p>\n\n\n\n<p>However, in O&#8217;Connor-Ratcliff v. Garnier, the <strong>9th Circuit Court of Appeals<\/strong> ruled that two <strong>California <\/strong>school board members may have violated First Amendment rights when they blocked two parents after they posted critical comments.<\/p>\n\n\n\n<p>It is the difference of circuit court opinion between the two similar cases that brought this issue to the Supreme Court, Green said.<\/p>\n\n\n\n<p>&#8220;Because they took both cases, (the Supreme Court isn&#8217;t) likely to reverse both of them, but it is possible they could come up with a third way to solve this,&#8221; the <strong>Ole Miss<\/strong> law professor said. &#8220;It&#8217;s the kind of problem you&#8217;ve had for centuries, where you have individual people with more than one hat.<\/p>\n\n\n\n<p>&#8220;Here, it&#8217;s just very, very easy to manufacture a new hat.&#8221;&nbsp;<\/p>\n\n\n\n<p>The cases bear resemblance to a\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/u12097671.ct.sendgrid.net\/ls\/click?upn=9rudYHeevExQpJ5A1h-2BA7RmPqmWOHolDiRvkcS8hbNNTU-2F8NbXnsx6a9vmWWrKdoy29sTgNR9cP9Z5UeBFUJyaqJB-2Bwl-2FITn9mO-2Fb1nS05B1x5hZrRdzFT0Cd0toYroCvpXIwl49r14WrtuNXF1CgnyljQTXz-2Bezjkp0JNsJW5o-3Di41K_NCASQegA8-2BF9JzL0ljDze6GdMp-2BDqoMSjHakCwO0HlyzU7Oqe0-2BPwAidkgPe1s4CS2wV8N3G7h55G0DDIQcTHpuOKy1Qbo0YhaGWBqAsBvbQcDB6cYOTpuPiIF-2Bq3TiVGCPN8Szm5I-2Fqihtpp2FZGM2F5OFaS88EDZCDWNZy3o5jeTk8REu-2FpjBBi2RVgzsbD-2Be9j5NzsW1-2BIawvC6jYxdoApnWCEOiSxFfJ0fg7fT8b9XuYveIY8PjR-2B4OOUee1AQ-2BZB6dN8iTpW4Yx-2BEs9RkDxC5X6tTi81ojsiL0jxOUzE6G-2BtFfzK3w7Ie2z1nrmb66cRUENsenDvJutW9dpsXNV5yBhY-2Fi-2Fxo6SO5Zb6ky7FkRevEQpPOTmra2X-2B5b8XXAlxCYTdyQ0AJ5jQCYfnayrrvPYEd5MTLO-2FWL3Zemo7CDh8aKR-2Fpw9tizB64SSltpoXrXPEL-2B9IrcIYyGBYBYo0-2BNT5pyNi1PnCi3F9poPC-2FTYapewzJbR4A6aS7kKjXEcVCbwkPWCc8gEoJQ7LxeL0sQ-2FpmaaNW52TNTCL3OuM3ZRKVYjGnJP-2Fb7vlw-2FBc3MPdylO-2FsbZqkHIqlnY4OA-3D-3D\" target=\"_blank\">lawsuit regarding former <strong>U.S. President Donald Trump<\/strong>&#8216;s social media account<\/a>, where the president had blocked several people who criticized him. The Supreme Court tossed that suit, though it had succeeded in lower courts, on the basis that Trump was no longer president.<\/p>\n\n\n\n<p>The primary concern of the upcoming cases is determining whether the city manager and school board members were acting in their public official roles on their social media accounts, Green said.<\/p>\n\n\n\n<p>The school board members created personal, public Facebook and <strong>X<\/strong>, formerly known as <strong>Twitter<\/strong>,\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/u12097671.ct.sendgrid.net\/ls\/click?upn=9rudYHeevExQpJ5A1h-2BA7ZK5XhkFAbjtwA2YakAKRwck25qlcEq2WTY5lPR5QmmbWn-2Bi8S8x1FrlmJjx14Cu-2FpFyc4yXzagJJ1d0aZWK2hMmLVafHutaLVPVJEnuVLmh9Y70ZCBZcsN3Dkf-2B4co4lblO62hgzJw7nsakxvh7gbs-3DpOzH_NCASQegA8-2BF9JzL0ljDze6GdMp-2BDqoMSjHakCwO0HlyzU7Oqe0-2BPwAidkgPe1s4CS2wV8N3G7h55G0DDIQcTHpuOKy1Qbo0YhaGWBqAsBvbQcDB6cYOTpuPiIF-2Bq3TiVGCPN8Szm5I-2Fqihtpp2FZGM2F5OFaS88EDZCDWNZy3o5jeTk8REu-2FpjBBi2RVgzsbD-2Be9j5NzsW1-2BIawvC6jYxdoApnWCEOiSxFfJ0fg7fT8b9XuYveIY8PjR-2B4OOUee1AQ-2BZB6dN8iTpW4Yx-2BEs9RkDxC5X6tTi81ojsiL0jxOUzE6G-2BtFfzK3w7Ie2z1nrmb66cRUENsenDvJutW9dpsXNV5yBhY-2Fi-2Fxo6SO5Zb6ky7FkRevEQpPOTmra2X-2B5b8XXAlxCYTdyQ0AJ5jQCYfnYT9vpd8IeZEsl1xrxRGoMplcSxFisZN6c-2BXsPKRhL5a6-2FUtrtIAxjjCpIBDAP5KeV-2BLZIoc4LUv7-2FvSusfGLzZT1QU8R6PMhCfjL7EbuhwLylRFEA3H0SD4QP-2F12Pzd93JRqpMzPIt0jyqigeN27ESkORtIA6vY28dYzZzjSMyvLwvKRrVyM60qwmq-2Bz6oekQ-3D-3D\" target=\"_blank\">accounts before they were elected that they used for campaign purposes, to address public issues and for official business<\/a>.<\/p>\n\n\n\n<p>Freed made his Facebook page while in college and used it primarily for personal reasons, though he did post public news and official business after he became city manager, court documents said. I&#8217;ll block you on Facebook.&#8217;&nbsp;<\/p>\n\n\n\n<p>&#8220;If you&#8217;re acting as a government officer, mere annoyance isn&#8217;t enough.
