The litigants in part challenged the federal government\u2019s authority to make such a determination.\u00a0\u00a0<\/p>\n\n\n\n<p>Green, who holds the <strong>Jamie L. The article gave particular attention to\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/u12097671.ct.sendgrid.net\/ls\/click?upn=9rudYHeevExQpJ5A1h-2BA7ds-2BD64NSaUh-2BiVeXxtho91QRXdQY7edi6rahaLgVrVtUQfWzO5CZhyopO5ZIb0Lln3V4kwOKvYitwt-2B3bfKQ5-2Fqh1hE4FPKhYSyIUR4fXw2yGHZWLuAMem9JGMSStY7vA-3D-3DMU5d_NCASQegA8-2BF9JzL0ljDze6GdMp-2BDqoMSjHakCwO0HlyzU7Oqe0-2BPwAidkgPe1s4CS2wV8N3G7h55G0DDIQcTHpuOKy1Qbo0YhaGWBqAsBvbQcDB6cYOTpuPiIF-2Bq3TiVGCPN8Szm5I-2Fqihtpp2FZGM2F5OFaS88EDZCDWNZy3o5jeTk8REu-2FpjBBi2RVgzsbD-2Be9j5NzsW1-2BIawvC6jYxdoApnWCEOiSxFfJ0fg7fT8b9XuYveIY8PjR-2B4OOUee1AQ-2BZB6dN8iTpW4Yx-2BEs9RkDxC5X6tTi81ojsiL0jxOVtAQaSi7IxG-2FrAQ42hQvfgdE38cbuARJWUB1y5RKtrHURYaHUWKnSu5OEa7tU7Pc0Yi9NlYLtFRkjQirCEYp66FOSv1zx3szcBpPpTXwKTNtBNraoy16peLLGC93WDussb9qFioGAu1dbNK3Zoxq7qapjMjAOZbro8056MW2jzQ6I3NPBnKnCLXTp1-2Buzw4i23L-2FrMpqF-2FW-2BgX0LLPktLK7qZXVd8QCV-2BF22ZKIMAHTDb-2BLz3DzaZuSr3XZ35Fu35L0NRTFAU6D7GGNXQAETPHNQAhCdxURwGTd6DdJQt-2BIw-3D-3D\" target=\"_blank\">a Supreme Court case from 1866<\/a>\u00a0and early correspondence about the commerce powers between <strong>George Washington<\/strong> and his first <strong>Attorney General<\/strong>, <strong>Edmund Randolph<\/strong>, which both Justice Gorsuch and Justice <strong>Clarence Thomas<\/strong> discussed in their opinions.\u00a0<\/p>\n\n\n\n<p>Gorsuch referenced Green\u2019s article three times in his concurrence with the majority opinion.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cThe past is relevant; the past has a lot of details,\u201d Green said. \u201cAll this historical stuff we&#8217;re digging into, it matters and it\u2019s encouraging to know that it matters to the Supreme Court.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>This is not the first time the Supreme Court has referenced Green\u2019s research, said <strong>Ron Rychlak<\/strong>, distinguished professor of law and a fellow Jamie L.
