Chris Green\u2019s recent article makes multiple appearances in decision to uphold Indian Child Welfare Act\u00a0<\/em><\/h2>\n\n\n\n

U.S. Supreme Court<\/strong> Justice<\/strong> Neil Gorsuch<\/strong> referenced the work of\u00a0University of Mississippi<\/strong><\/a>\u00a0law<\/a>\u00a0professor Chris Green<\/strong> multiple times in a recent ruling.\u00a0\u00a0<\/p>\n\n\n\n

In\u00a0Haaland v. Brackeen<\/strong><\/a>, justices voted 7-to-2 to uphold the power of the\u00a01978 Indian Child Welfare Act<\/strong><\/a>, which in part provides that if Native American<\/strong> children are removed from a dangerous or unfit home, a preference is to be given to transferring custody to a member of a Native American tribe. The litigants in part challenged the federal government\u2019s authority to make such a determination.\u00a0\u00a0<\/p>\n\n\n\n

Green, who holds the Jamie L. Whitten Chair of Law and Government<\/strong>, recently published an article in the Penn State Law Review<\/em><\/strong> entitled\u00a0\u201cTribes, Nations, States: Our Three Commerce Powers,\u201d<\/a>\u00a0in which he researched the original meaning of Congress’s power over commerce.\u00a0<\/p>\n\n\n\n

Green’s article highlighted the federal government’s power to govern relationships with tribes as groups of individuals and as\u00a0sovereign governments<\/a>. The article gave particular attention to\u00a0a Supreme Court case from 1866<\/a>\u00a0and early correspondence about the commerce powers between George Washington<\/strong> and his first Attorney General<\/strong>, Edmund Randolph<\/strong>, which both Justice Gorsuch and Justice Clarence Thomas<\/strong> discussed in their opinions.\u00a0<\/p>\n\n\n\n

Gorsuch referenced Green\u2019s article three times in his concurrence with the majority opinion.  <\/p>\n\n\n\n

\u201cThe past is relevant; the past has a lot of details,\u201d Green said. \u201cAll this historical stuff we’re digging into, it matters and it\u2019s encouraging to know that it matters to the Supreme Court.\u201d  <\/p>\n\n\n\n

This is not the first time the Supreme Court has referenced Green\u2019s research, said Ron Rychlak<\/strong>, distinguished professor of law and a fellow Jamie L. Whitten Chair of Law and Government at Ole Miss<\/strong>.\u00a0\u00a0<\/p>\n\n\n\n

\u201cWhat really goes to the importance to Chris\u2019 scholarship is he\u2019s giving a rationale for the use of federal power,\u201d Rychlak said. \u201cThe highest court in the land is looking at constitutional theory and how we approach the authority of the federal government to act on various matters, and they\u2019re turning to Chris Green\u2019s article to do so. <\/p>\n\n\n\n

 \u201cHe’s influencing them as they make these decisions, and that’s the ultimate compliment you can pay to a legal scholar.\u201d  <\/p>\n\n\n\n
